When to Count New Construction
New construction units count when a building permit is issued for vertical construction, meaning work that establishes the physical structure of the building (e.g., foundation, framing, or full building permits), and an affordability mechanism is in place. If a local government does not issue building permits, equivalent construction authorization documents, such as a resolution, serve the same purpose, and therefore units would be counted on the date of approval.
New Construction Rental Housing
To count as a Proposition 123 rental unit, newly constructed housing must be affordable to households at or below 60% AMI and have an affordability mechanism.
New Construction Ownership Housing
To count as a Proposition 123 ownership unit, newly constructed homes must be affordable to households earning up to 100% AMI. Affordability must be secured through resale restrictions, ensuring that future buyers also meet income qualifications. Mortgage payments must remain within 30% of household income at 100% AMI to qualify.
