The Division of Housing is excited to share that it now has oversight over the Mobile Home Park Act ("Act") allowing home owners and landlords with concerns that the Act is being potentially violated to bring those concerns to a state agency as an option rather than having to resolve those issues in court, which can be costly. House Bill 19-1309 was signed into law by Governor Polis on May 23, 2019, and establishes the following three important changes:
- Provides mobile home owners additional time to sell or move their homes by extending the time to vacate the mobile home park after the court enters an eviction order,
- Allows counties to ensure the Act is upheld by granting county boards of commissioners additional permissive authority to regulate and enforce regulations of mobile home parks through the unincorporated areas of the counties, and
- Establishes the Mobile Home Park Act Dispute Resolution &, Enforcement Program ("Program") to support better communication and promote mutual understanding between mobile home owners and mobile home park owners, management, and landlords.

In its report, DORA identified harm occurring in some mobile home park settings in our state when it was asked to review whether or not park owners or managers should be licensed, instead of licensure it recommended enforcement of existing laws, which was then used as the basis to create the Program.
The Division is currently working to implement the Program, which requires mobile home parks to register with the Division by February 1, 2020, and to create a process in which to receive and resolve complaints concerning alleged violations of the Act and/or Program on and after May 1, 2020. In order to assist the Division with implementing this newly created oversight program, it will undergo a public rule making process to clarify statutory requirements. Therefore, we are asking for valued input from interested stakeholders to include local jurisdictions, mobile home owners renting space in a mobile home park, mobile home park owners/managers, and any other interested parties. You may attend stakeholder meetings in person or remotely to learn more about the Program and changes to the Act, and help identify rules that will bring clarity to what is expected in order to comply with these new requirements established in law.
